The appellant, Amir Ismail Patel @ Ammu, was convicted by the Additional Sessions Judge, Greater Mumbai on 10th December 2015 for offences punishable under Sections 307, 324 and 506 of the Indian Penal Code (IPC) and sentenced to rigorous imprisonment for ten years, one year and six months respectively, with fines. The case of the prosecution was that on 1st April 2013, the complainant Akhtari Begam Babu Khan saw the appellant and two others abusing Imtiaz Jamil Ahmed Khan. The appellant allegedly picked up a knife from a butcher's shop and assaulted Imtiaz. When the complainant intervened, she sustained an injury on her palm. She later lodged a report at Antop Hill Police Station, leading to the registration of Crime No. 58 of 2013. The appellant was arrested on 3rd April 2013 and tried in Sessions Case No. 574 of 2013. The prosecution examined eight witnesses. The appellant challenged the conviction in the High Court. The High Court found material contradictions in the evidence of the complainant and other witnesses regarding the identity of the assailant and the sequence of events. The court noted that the complainant's testimony was inconsistent with the medical evidence and the statements of other witnesses. The court held that the prosecution failed to prove the guilt of the appellant beyond reasonable doubt. Consequently, the appeal was allowed, the conviction and sentence were set aside, and the appellant was acquitted of all charges.
