Case Note & Summary
The petitioner, Mrs. Ivy C. da Conceicao, filed a writ petition challenging the appointments of respondents No.4 to 7 as Principals of Higher Secondary Schools run by respondent No.3, Diocesan Society. The petitioner contended that her name was not considered for promotion as required under Rule 74 of the Goa School Education Rules, 1986, and that the appointments were made in breach of Rule 86 read with Rule 78, as the respondents were junior to her and not within the zone of consideration. The petitioner also argued that no promotion committee was constituted as mandatorily required. The court, after hearing the parties, found that the appointments were made without following the prescribed rules, particularly the requirement of a promotion committee and consideration of seniority. The court allowed the petition and quashed the appointments of respondents No.4 to 7.
