Case Note & Summary

The Maharashtra State Cooperative Bank Ltd. (petitioner) had advanced loans to Yashwant Sahakari Sakhar Karkhana (respondent No.4), a sugar factory, and the entire sugar stock was pledged to the bank by executing deeds of pledge. The Assistant Commissioner of Labour passed an order under Section 33C(1) of the Industrial Disputes Act, 1947, certifying workers' dues of Rs. 14,01,09,606.49 and directing recovery by sale of sugar bags and other property under the MLR Code, 1966. The Tahsildar attached 82,092 quintals of sugar bags. The bank challenged the order, arguing that the direction to recover under MLR Code was beyond the scope of Section 33C(1) and that the bank's pledge rights over the sugar stock should be protected. The court held that the part of the order directing recovery under MLR Code was beyond the power under Section 33C(1). However, the court directed the Tahsildar to sell the attached sugar by public auction with adequate notice to the bank and the factory, and allowed the bank to participate in the auction and bring buyers to ensure adequate price realization. The court did not decide on the priority of the bank's pledge rights but permitted the bank to participate in the auction.

The Collector passed an order on 5 July 2012 pursuant to that direction. The bank filed the present writ petition challenging the Collector's order.
