The petitioner, Mormugao Municipal Council, a municipal council established under the Goa Municipalities Act, 1968, invested a sum of Rs. 6,00,000/- in Kisan Vikas Patra (KVP) certificates on 15 April 2002, under certificate numbers 99CC348491 to 99CC348550 of Rs. 10,000/- each. Upon maturity, the respondents were obligated to pay Rs. 12,00,000/- to the petitioner. On 14 December 2009, the petitioner wrote to respondent No. 3, the Post Master, Vasco Town Post Office, requesting payment. Respondent No. 3 forwarded the letter to respondent No. 2, the Senior Superintendent of Post Offices, Goa Division, for further action. However, the respondents did not make the payment, leading the petitioner to file a writ petition under Article 226 of the Constitution of India seeking a writ of mandamus to compel the respondents to release the maturity amount along with interest at 18% per annum from the date of maturity. The respondents opposed the petition, primarily on the ground that the claim was barred by limitation under the Limitation Act, 1963, as the cause of action arose in 2009 and the petition was filed in 2012. The court, after hearing both sides, held that although the claim was barred by limitation, the respondents had not raised the plea of limitation in their affidavit and the claim was not hopelessly barred.
