Case Note & Summary
The case involves an appeal by the State of Goa and the Deputy Collector (L.A.) against a judgment and decree dated 15/11/2006 passed by the Ad hoc Additional District Judge-I, Panaji, in Civil Suit No.272/2004. The respondent, Communidade of Pilerne, had filed a suit for recovery of Rs.48,79,925/- with interest at 15% p.a. from 15/03/2002 till payment, claiming interest under Section 34 of the Land Acquisition Act, 1894. The facts are that an area of 290350 square metres of land belonging to the Communidade was acquired for setting up an industrial estate. The Deputy Collector made an award on 06/08/1993 fixing compensation at Rs.10 per square metre, totaling Rs.39,94,106/-. However, the Deputy Collector did not disburse the compensation to the Communidade because the names of tenants were not removed from survey records and the lands allotted to tenants had not been demarcated, creating a title dispute. He ordered the amount to be kept in revenue deposit until the Communidade established a clear title. The Communidade later obtained a judgment in Civil Suit No.111/1998/SR on 19/01/1999, which confirmed its title. Possession of the land was taken on 15/03/2002. The trial court decreed the suit in favor of the Communidade, awarding interest under Section 34 from the date of the award (06/08/1993) until payment. The State appealed. The High Court framed the issue of whether interest under Section 34 is payable from the date of award or from the date of taking possession. The court analyzed Section 34 and relevant precedents, holding that interest under Section 34 accrues only from the date the Collector takes possession of the land, not from the date of the award. Since possession was taken on 15/03/2002, interest is payable only from that date. The court also held that the Collector was justified in withholding compensation due to the title dispute, and the amount kept in revenue deposit did not entitle the Communidade to interest for the earlier period. The appeal was allowed, the trial court's decree was set aside, and the suit was dismissed.
Headnote
A) Land Acquisition - Interest under Section 34 - Commencement of Interest - Section 34 of the Land Acquisition Act, 1894 - The court considered whether interest under Section 34 is payable from the date of award or from the date of taking possession. The court held that interest under Section 34 accrues only from the date the Collector takes possession of the land, not from the date of the award. Since possession was taken on 15/03/2002, interest under Section 34 is payable only from that date, not from the date of the award (06/08/1993). (Paras 7-10) B) Land Acquisition - Withholding Compensation - Title Dispute - Section 31 of the Land Acquisition Act, 1894 - The court examined whether the Collector was justified in withholding compensation and keeping it in revenue deposit due to a dispute regarding the title of the Communidade. The court held that the Collector was justified in withholding compensation because the names of tenants were not removed from survey records and the lands allotted to tenants had not been demarcated, creating a cloud on the title. The Collector's action was in accordance with Section 31(2) of the Act. (Paras 4-6) C) Land Acquisition - Interest on Revenue Deposit - Entitlement - Section 34 of the Land Acquisition Act, 1894 - The court addressed whether the plaintiff is entitled to interest on the amount kept in revenue deposit. The court held that since the compensation was not paid or deposited in court under Section 31(2), but was kept in revenue deposit due to the plaintiff's failure to establish clear title, the plaintiff is not entitled to interest under Section 34 for the period the amount remained in revenue deposit. Interest under Section 34 is payable only from the date of taking possession, which was 15/03/2002. (Paras 7-10)
Issue of Consideration
