The petitioner, Vinod Ramling Ghogare, filed a writ petition before the Bombay High Court challenging an order dated 6th May 2009 passed by the Divisional Caste Verification Committee, Latur, which rejected his caste claim as belonging to the 'Gondhali' caste, classified as NTB in Maharashtra. The petitioner had secured admission to a Bachelor of Engineering (Electronics and Telecommunication) course at Padmabhushan Vasantdada Patil Institute of Technology, Bhadgaon, for the academic year 2008-09 based on that claim. On 9th July 2009, the High Court granted interim relief directing that no action be taken against the petitioner solely on the ground of invalidation of his tribe claim. However, when the petition was called for hearing on 6th March 2012, no one appeared for the petitioner, and the court dismissed the petition for non-prosecution. The court noted that upon dismissal, the interim order stood vacated. The court also referred to the Maharashtra Scheduled Castes, Scheduled Tribes, De-Notified Tribes, (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 (Maharashtra Act No.XXIII of 2001), under which the Scrutiny Committee had acted. The dismissal effectively upheld the rejection of the caste claim.
