The Petitioner, M/s. Hindustan Petroleum Corporation Limited, challenged the categorization of its LPG Gas Bottling Plant at Sangli under the HT II Commercial tariff category by the Maharashtra State Electricity Distribution Co. Ltd. (MSEDCL). The Maharashtra Electricity Regulatory Commission (MERC) had issued a tariff order on 31st May, 2008, creating a new HT II Commercial category for commercial consumers, including hospitals. The Petitioner contended that its LPG bottling activity is a manufacturing process and should be classified under HT I Industrial category. The Respondent argued that bottling is not manufacturing and thus commercial rates apply. The Court, after hearing both sides, held that the LPG bottling plant involves a manufacturing activity, as it transforms raw LPG into packaged cylinders, and therefore the Petitioner is entitled to the HT I Industrial tariff. The Court directed the Respondent to revise the bills accordingly and refund any excess amount charged. The petition was allowed with rule made absolute.
