The petitioner, Shri Mahableshwar Pandurang Halankar, filed a writ petition challenging an order dated 30.06.2008 passed by the Civil Judge, Senior Division at Mapusa in Special Civil Suit No. 36/2002/II, which rejected his application to strike off Issue No.6 framed on 02.05.2007. Since the respondents failed to provide specific pleadings regarding their occupation, the issue of Mundkar rights could not be sustained. The court allowed the petition, set aside the impugned order, and directed the trial court to strike off Issue No.6.
