The State of Maharashtra appealed against the judgment and order dated 6.1.2000 passed by the Judicial Magistrate, First Class, Purna, in Regular Criminal Case No.485 of 1997, acquitting the respondents (original accused) for offences under Sections 326 and 324 read with Section 34 of the Indian Penal Code. The prosecution case was that on 27.4.1997 at about 22.00 hours, the accused persons, in furtherance of common intention, assaulted the complainant Prabhakar Eknathrao Chavan with an axe and a stick, causing grievous hurt. The complainant lodged a complaint on 28.4.1997, leading to registration of CR No.52/1997 under Sections 326, 504 and 506 read with Section 34 IPC. After investigation, charge sheet was filed and charges were framed under Sections 326 and 324 read with Section 34 IPC. The prosecution examined 13 witnesses. The trial court acquitted the accused. The High Court, hearing the appeal, found that the medical evidence was inconsistent with the ocular testimony, as the doctor did not mention the use of an axe or stick. Many witnesses turned hostile. The court held that the trial court's acquittal was not perverse and did not warrant interference. The appeal was dismissed.
