The petitioners were landowners whose land had been occupied by Defence authorities since 1942 for defence purposes. An award was passed on 30-05-1995 under the Land Acquisition Act, 1894, but compensation remained unpaid. After prolonged correspondence, the authorities sought to withdraw from the acquisition under Section 48(1) of the Act. The petitioners challenged the withdrawal in Writ Petition No.1855 of 2001 before the Bombay High Court, which on 17-06-2009 allowed the writ, quashed the withdrawal order, and directed payment of compensation as per the award dated 30-05-1995 within three months along with interest as contemplated under the provisions of the Act. The special leave petition filed by the respondents against this order was dismissed by the Supreme Court on 05-10-2009. Despite the judgment, payment was delayed, forcing the petitioners to file contempt petitions. In Contempt Petition (L) No.26 of 2010, the respondents offered compensation of Rs.64,81,72,626/- on 28-04-2010, which the petitioners accepted under protest, reserving their right to claim further entitlements, including interest on solatium. Consequently, the petitioners filed the present Notice of Motion seeking interest on the solatium component of the compensation. The core legal issue was whether interest is payable on solatium under Section 34 of the Land Acquisition Act, and if so, from what date. The petitioners contended that solatium is a statutory part of compensation and interest must be paid on the aggregate amount including solatium, relying on the Constitution Bench judgment in Sunder v. Union of India (2001) 7 SCC 211. They argued that interest should run from the date of dispossession. The respondents, on the other hand, relied on Gurpreet Singh v. Union of India (2006) 8 SCC 457, arguing that interest on solatium could only be claimed in pending executions and only from the date of the Sunder decision (19-09-2001). They further submitted that the earlier decree did not expressly grant interest on solatium. The High Court, after examining the authorities, held that Sunder clearly establishes that solatium is an integral part of compensation and interest is payable on the entire compensation amount. The direction in the court’s earlier judgment to pay compensation “along with interest as contemplated under the provisions of the Act” encompassed interest on solatium. On the question of the date from which interest was payable, the court followed Gurpreet Singh and a subsequent unreported Supreme Court decision in Shivappa Mallappa Jigalur, which explained that where execution is pending and the decree is silent, the execution court may grant interest on solatium from 19-09-2001. The court found that the execution in the present case was not closed, as the main proceedings were still alive. Accordingly, the court directed payment of interest on solatium from 19-09-2001 to 28-04-2010, the date of actual payment. The court clarified that interest on solatium was to be calculated only on the solatium amount and not on the total compensation. The Notice of Motion was allowed to that extent.
