Case Note & Summary

The petitioners, members of Sategaon Education Society, challenged an order dated 30.04.2010 passed by the Deputy Director of Education, Amravati Division, which withdrew the administrative and financial powers of the Headmistress of the school run by the trust and authorized the senior most teacher to manage the school. The court examined two questions: (1) whether education authorities have jurisdiction to decide trust management disputes, and (2) whether they can withdraw powers of the head of institution. The court held that the Deputy Director of Education has no jurisdiction to decide which trustees are entitled to administer the trust, as such disputes fall within the purview of the Charity Commissioner under the Bombay Public Trusts Act, 1950. Further, no provision under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 or the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 empowers the education authorities to withdraw the administrative or financial powers of the head of an institution. The impugned order was quashed and set aside, and the respondents were directed to restore the status quo ante.
