The petitioner, Kabir s/o Maroti Randaye, filed a writ petition challenging the order dated 2.9.1997 passed by the Committee for Scrutiny and Verification of Tribe Claims, Nagpur, which invalidated his claim for issuance of a Validity Certificate for 'Mana' Scheduled Tribe community and cancelled the Caste Certificate issued by the Executive Magistrate, Samudrapur, District Wardha on 9.11.1992. The Scrutiny Committee had relied on the Supreme Court judgment in Dadaji @ Dina v. Sukhadeobabu and Ors., AIR 1980 SC 150, to reject the claim. However, the petitioner contended that this judgment had been subsequently overruled by the Supreme Court in State of Maharashtra v. Mana Adim Jamat Mandal, 2006 (3) Mh.L.J. 407, which followed the earlier decision in State of Maharashtra v. Milind Katware, 2001 (1) Mh.L.J. (SC) 1. The court, comprising A. H. Joshi and R. K. Deshpande, JJ., heard the parties and noted that the Apex Court had indeed overruled Dadaji @ Dina in the Mana Adim Jamat Mandal case. Consequently, the order of the Scrutiny Committee, being based on an overruled precedent, could not be sustained. The court allowed the writ petition, setting aside the impugned order and directing the issuance of the Validity Certificate for the 'Mana' Scheduled Tribe community to the petitioner.
