Case Note & Summary
The State of Maharashtra appealed against the judgment of the Joint Civil Judge (Sr. Dn.), Amravati in Land Acquisition Case No.115 of 1992, which enhanced compensation for acquisition of land and orange trees. The land, Survey No.168 admeasuring 0.64 hectare at village Waghal, was acquired under Section 4 of the Land Acquisition Act, 1894 vide notification dated 15.10.1991. The Land Acquisition Officer awarded total compensation of Rs.2,10,212 by award dated 28.4.1992. The claimant sought reference under Section 18, claiming enhanced compensation of Rs.88,960. The Reference Court enhanced land compensation from Rs.30,000 to Rs.60,000 per hectare, relying on sale instance Exh.34 of dry land at Rs.37,500 per hectare, applying a 1.5 times multiplier for bagayat land. For 175 orange trees, the court enhanced compensation from Rs.1,45,068 to Rs.2,03,000 based on yield method. The High Court dismissed the appeal, holding that the Reference Court's approach was proper and no interference was warranted.

Filing Reason
The State challenged the enhancement of compensation for land and orange trees awarded by the Reference Court.

Issues
Whether the Reference Court was justified in enhancing compensation for bagayat land from Rs.30,000 to Rs.60,000 per hectare?
Whether the Reference Court was justified in enhancing compensation for orange trees from Rs.1,45,068 to Rs.2,03,000?
Submissions/Arguments
Appellants argued that the Reference Court erred in enhancing compensation for land and trees.
Respondent supported the Reference Court's judgment.
Ratio Decidendi
The Reference Court's determination of market value for bagayat land by applying a 1.5 times multiplier to a sale instance of dry land was proper, and enhancement for orange trees based on yield method was justified.
Judgment Excerpts
The Reference Court considered the sale instance (Exh.34) which was for dry land. The land in question being a bagayat land having fruit bearing Orange trees, the learned Judge of the Reference Court, taking into consideration all other factors, granted enhancement at 1 ½ times more than the price which was fetched for the sale instance at Exh.34 and determined the price of land in question @ Rs.60,000/- per hectare.
In my view, the approach adopted by the Reference Court in determining the market value of the land in question and also the compensation for the Orange trees cannot be said to be erroneous.
