The appellant, Mohammad Arif Asik Ali Raain, was convicted by the Special Judge under the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) in POCSO Special Case No.1 of 2014 for offences under Section 8 of the POCSO Act, Section 341 of the Indian Penal Code (IPC), and Section 354A of IPC. The incident occurred on 21st May 2013 at about 9:00 a.m., when the appellant threatened an 11-year-old girl and sexually assaulted her by touching her inappropriately. The trial court sentenced him to rigorous imprisonment for five years and a fine of Rs.2,000 under Section 8 of POCSO Act, with a default sentence of two months; a fine of Rs.500 under Section 341 IPC with a default sentence of fifteen days; and directed payment of Rs.20,000 compensation to the victim under Section 33(8) of POCSO Act, with a default sentence of six months. The appellant was not separately punished under Section 354A IPC due to Section 42 of POCSO Act. The appellant appealed against the conviction and sentence. The High Court heard the appeal and perused the entire record. The court noted that the prosecutrix was aged about 11 years at the time of the incident and, to protect her identity, avoided detailed narration of facts. The court found that the evidence of the victim and her mother was credible and sufficient to prove the appellant's guilt beyond reasonable doubt. The court held that there was no need for corroboration of the victim's testimony in sexual offences and that the trial court's findings were based on proper appreciation of evidence. Consequently, the High Court dismissed the appeal and upheld the conviction and sentence.
