The State of Maharashtra appealed against the judgment and order dated 16/12/1999 passed by the Additional Sessions Judge, Pune in Sessions Case No. 181 of 1998, acquitting the respondents (original accused Nos. 1 to 3) of offences under Sections 341, 364-A, 386 and 387 read with 34 of the Indian Penal Code. The prosecution case was that on 27/05/1997 at about 8.45 pm, the complainant Paras Mishrilal Bamb (PW-1), a hotel businessman, was forcibly stopped by an unidentified person while riding his Kinetic Honda scooter in Koregaon Park, Pune. The person claimed to be a policeman and forced the complainant into a blue Maruti Van, where three persons were present. The complainant was taken to various locations and later released after his brother paid a ransom of Rs. 1,00,000. The complainant lodged an FIR, and the accused were arrested. However, during trial, the complainant turned hostile and did not support the prosecution case. The trial court acquitted the accused, finding the evidence insufficient. The High Court, in appeal, examined the evidence and found that the complainant had resiled from his earlier statement, the identification parade was not conducted, and no independent witnesses corroborated the prosecution story. The court held that the trial court's view was plausible and not perverse, and therefore, the acquittal was upheld. The appeal was dismissed.
