The petitioner, Sunita Thakar, is the widow of Pradip Thakar, who was employed as a Chaukidar (a post reserved for Scheduled Tribe) with the Government Photozincographic Press, Pune. He was issued a tribe certificate by the Executive Magistrate, Kallam, and appointed on 01.03.1982. He was promoted as Supervisor in 2009. On 04.07.2013, he applied through his employer to the Scheduled Tribe Certificate Scrutiny Committee for validation of his tribe claim. Before the Committee could decide, he died on 06.11.2019 while in service. The petitioner then applied for family pension and retiral benefits, but was orally informed by the employer that since her husband was appointed on a reserved post and had not submitted a validity certificate, benefits could not be released. She requested the Committee to decide the pending claim, but on 05.08.2020, the Committee closed the file due to the death of the employee. The petitioner filed a writ petition seeking a direction to the Committee to decide the caste claim and to the employer to release benefits. The court held that the caste scrutiny proceedings do not abate on the death of the employee; the Committee must decide the claim on merits to enable the family to receive retiral benefits.
