The case arises from a motor accident claim filed by the widow and son of Kashinath Zanje, who died in a road accident on 21 February 2015. The deceased was riding a motorcycle on Mumbai-Goa Highway when an MSRTC bus (bearing No. MH-14-BT-1926) driven rashly and at high speed dashed his motorcycle. He sustained grievous injuries, was initially treated at Rural Hospital, Mahad, then referred to J.J. Hospital, Mumbai, where he succumbed on 25 June 2015. The claimants sought compensation of Rs. 50,00,000 with 12% interest. The MSRTC contested, alleging contributory negligence by the deceased. The Motor Accident Claims Tribunal, Mumbai, in Claim Petition No. 606 of 2015, awarded Rs. 18,91,600 with 7.5% interest from the date of petition. The MSRTC appealed under Section 173 of the Motor Vehicles Act, 1988. The High Court examined the evidence, including the FIR, panchnama, and the fact that the bus driver did not appear to contest. The court held that the Tribunal correctly applied the principle of preponderance of probabilities and found the bus driver negligent.
