The plaintiff, PVR Ltd., filed a Commercial Summary Suit against the defendants, Proetus Ventures LLP and its partners, Shardul Bayas and Abhinay Ramesh Deo, for recovery of unpaid rent and mesne profits in respect of a lease agreement. The plaintiff claimed that the defendants had failed to pay rent from July 2022 onwards and that the lease was terminated by a notice dated 30 September 2022. The defendants filed an appearance and sought leave to defend, arguing that the lease was validly terminated by the plaintiff and that the partners were not personally liable as the lease was signed by one partner in a representative capacity.
