Case Note & Summary

The petitioner, Rajendra S/o Baburao Patil, a retired employee of Zilla Parishad, Jalgaon, filed a writ petition seeking deemed date of promotion to the post of Junior Accountant from 30/08/2007, along with consequential arrears. He was appointed as a Clerk and later as a Junior Clerk. Disciplinary proceedings were initiated against him, but the Enquiry Officer exonerated him of all charges. However, the employer (Divisional Commissioner) passed an order dated 19/08/2022 partly disagreeing with the Enquiry Officer's findings and attaching stigma to the petitioner's career, which affected his promotion. The petitioner contended that despite exoneration, he was denied promotion from the deemed date. The respondents argued that the disagreement was justified. The Court observed that the employer had ignored fundamental principles of service jurisprudence by attaching stigma despite exoneration. The Court held that the impugned order was unsustainable and quashed it. It directed the respondents to grant the petitioner deemed date of promotion from 30/08/2007 and pay arrears of monetary benefits. The petition was allowed with rule made absolute.
