The High Court held that the examination passed by her in 1977 was valid in law and that its cancellation on the ground of malpractice in the second examination was not valid. That order became final. Despite this, the respondent terminated the appellant's service for failure to pass the Tamil language test after her regular appointment. The only question before the Supreme Court was whether the appellant's service could be terminated for her failure to pass the examination. The Court noted that she did not pass the examination after her regular appointment, but she had passed it while she was in temporary service. Since the High Court's order invalidating the cancellation of the 1977 examination had become final, it was no longer open to the respondent to terminate her services on that ground. The appellant contended that she had already passed the required language test during her temporary service and the cancellation of that pass had been quashed by the High Court; therefore, termination was illegal. The respondent contended that the appellant had not passed the examination after her regular appointment and had been involved in malpractice in the second attempt, justifying termination. The Supreme Court reasoned that the finality of the High Court order removed the basis for treating the appellant as not having passed the test. Since the condition for regularization was met through the earlier valid pass, the termination could not stand. The respondent was directed to regularize the appellant's service, giving her past benefits of temporary service with effect from 1975-76 for the purpose of perusal. However, seniority would be determined with effect from the date of her regular appointment in August 1990, as she was a direct recruit. The appeal was allowed and no costs were awarded.
