The respondent joined the Chandigarh Administration as an Assistant Engineer on June 24, 1976, and challenged the seniority assigned to the appellant from the date of his deputation, arguing it was not in public interest. The Central Administrative Tribunal ruled in favor of the respondent, placing the appellant at the bottom of the seniority list. The Supreme Court, however, found that the Tribunal failed to consider Rule 12(5) of the Punjab Service of Engineers Rules, which allows for seniority to be assigned from an earlier date if it serves the public interest. The court noted that the appellant's qualifications were superior to those of the respondent and that there was no evidence of improper motive in the seniority assignment.
