Case Note & Summary

The case involved an appeal by the Accounts Officer (A&I) of the Andhra Pradesh State Road Transport Corporation against the decision of the Andhra Pradesh High Court regarding the regularization of services of contract employees. The respondents were appointed as contract sweepers and attendants in 1992 and claimed regularization after completing 240 days of continuous service. They filed a writ petition in 1996, which led to a directive from the High Court for their regularization. However, the corporation rejected their representation, stating that regularization could only occur through a proper selection process. The respondents contended that a circular from 1988 allowed for their regularization. The Single Judge of the High Court ruled in favor of the respondents, but the corporation appealed. The Supreme Court, referencing the Constitution Bench decision in Uma Devi's case, ruled that regularization outside the established rules and constitutional provisions was impermissible. The court emphasized that even long-term contract workers could not be regularized without following the proper selection process. Consequently, the Supreme Court allowed the appeal, set aside the High Court's judgments, and dismissed the writ petitions.
