Case Note & Summary

This case involved an appeal against a life sentence for murder under Section 302 of the Indian Penal Code (IPC). The appellant, Lal Singh, was convicted by the First Additional Sessions Judge, Alirajpur, for the murder of a 19-year-old boy named Magan. The incident occurred on February 11, 1994, when Magan climbed a Tadi tree belonging to Lal Singh, leading to a confrontation. Eyewitnesses, including Magan's sister Gauri and brother Jagla, testified that they saw Lal Singh pressing Magan's neck and tying a rope around it. Despite one witness turning hostile, the court found the testimonies of Gauri and Jagla credible and corroborated by medical evidence indicating asphyxia as the cause of death. The defense argued that the medical report did not support the prosecution's case, suggesting suicide instead. However, the court rejected this argument, emphasizing the improbability of suicide occurring in Lal Singh's house. The High Court's brief handling of the appeal was criticized, but the Supreme Court found no grounds for remanding the case, as the High Court had adequately considered the material facts. Ultimately, the appeal was dismissed, affirming the conviction and life sentence of the appellant.
