Case Note & Summary

The appeal arose from a challenge to the rejection of the appellant's application for the post of Munsif in the Jammu and Kashmir Judicial Service due to exceeding the age limit. The appellant, born on 31.1.1965, was appointed as an adhoc Munsif in 2001 and applied for a regular post when the Jammu and Kashmir Public Service Commission issued a notification on 4.12.2001, which required candidates to be under 35 years of age as of 1st January of that year. The Commission rejected his application on 21.5.2002, stating he was overage by eleven months. The appellant filed a writ petition which was dismissed by a Single Judge, and the dismissal was upheld by a Division Bench of the High Court. The appellant argued that there should be age relaxation for Scheduled Tribe candidates based on historical resolutions and government policies. However, the respondents contended that the rules did not provide for such relaxation and that the age limit was strictly applicable. The court analyzed the relevant rules and previous judgments, concluding that the recruitment rules did not allow for age relaxation for Munsif positions. The court noted an anomaly in the absence of age relaxation for Munsifs compared to Higher Judicial Services but emphasized that the rules must be interpreted strictly. The court dismissed the appeal but suggested that the High Court should consider whether to provide age relaxation for Scheduled Castes and Scheduled Tribes in future recruitment processes. The appeal was dismissed without costs.
