Case Note & Summary

The case involved a Special Leave Petition for anticipatory bail filed by the petitioner, against the State of Madhya Pradesh concerning allegations of rape and other offences under the Bharatiya Nyaya Sanhita, 2023 and the SC & ST (Prevention of Atrocities) Act, 1989. The High Court had quashed the complaint based on a compromise between the parties. The Supreme Court expressed concern over the nature of the offences and the implications of allowing quashing based solely on a compromise, particularly in non-compoundable cases like rape. The court referred to several precedents that highlighted the distinction between compoundable and non-compoundable offences and cautioned against the potential for coercion in settlements. Upon interaction with the victim, it was revealed that she felt coerced into the settlement, which further justified the court's apprehensions. The Supreme Court ultimately set aside the High Court's order, directed the trial to proceed, and granted anticipatory bail to the petitioner with conditions to cooperate with the investigation. The court emphasized that settlements in serious offences should not be taken lightly and must be scrutinized to prevent abuse of the judicial process.

Judgment Excerpts

We are not prima facie satisfied that the cases referred to by the learned Single Judge of the High Court would enable invocation of the power under Section 528 to quash the complaint, on a compromise where a heinous offence of rape is alleged.
