Case Note & Summary

The dispute involved seven Petitioners claiming exclusive use and possession of certain units on Railway land at CTS No.10A, Rajeev Gandhi Nagar, Kurla. They contended that they had occupied the land for several decades without interruption. In 2022, the Railways issued eviction notices under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, prompting the Petitioners to challenge these notices in court. The Petitioners relied on a precedent from the Supreme Court regarding the need for rehabilitation of occupants on Railway property. The court sought clarification on whether the land belonged to the Railways or private entities and confirmed that the Petitioners were indeed on Railway land within a safety buffer zone. The court noted that the Railways had previously issued notices to various encroachers and directed that fresh notices be issued to all unauthorized occupants, allowing them 30 days to vacate. The court emphasized the need for proper rehabilitation measures for those evicted, including potential compensation and access to housing schemes. The court ultimately directed the Railways and local authorities to follow through with the eviction process while ensuring the rights of the occupants were considered. The Petition was disposed of with specific directions for compliance and rehabilitation efforts.
