Case Note & Summary

The dispute arose from a public auction conducted by the Jammu Development Authority (JDA) in which S. Paramjeet Singh was the successful bidder for a plot in Trikuta Nagar Housing Colony, Jammu. After his bid of Rs. 8,30,000 was accepted, he was required to pay 50% of the premium within 30 days and the remaining 50% within 60 days. Although he deposited the first installment of Rs. 4,15,000, he failed to pay the second installment, leading the JDA to cancel the allotment and advertise for a fresh auction. Singh contested this cancellation by filing an Original Writ Petition, which was allowed by the High Court, leading to the JDA's appeal. The Supreme Court found that Singh's defaults were clear and that the High Court's decision to uphold the allotment was erroneous. The court directed that the plot be re-auctioned and ordered the refund of the earnest money paid by the new bidder, Vivek Mahajan, along with interest, while forfeiting Singh's earnest money. The appeal was allowed, and the previous judgment was set aside.
