Case Note & Summary

The dispute arose from a common judgment by the Division Bench of the High Court for the State of Telangana, confirming a Single Judge's decision regarding the partition of the Khurshid Jah Paigah estate. The appellants, claiming to be assignees of the decree, challenged the High Court's ruling. The historical context of the Paigah estate, granted by the Nizam for military maintenance, was crucial to understanding the claims. The estate was divided among heirs following the Nizam's directives, which historically prohibited partition. The appellants sought to partition the estate after the abolition of Jagirs in 1949, arguing that the previous restrictions ceased to apply. The court analyzed the historical grants, the nature of the Paigah estate, and the implications of the Nizam's Farmans, ultimately determining that the heirs were entitled to seek partition of the estate. The court's decision emphasized the need to respect the historical context while recognizing the legal changes that allowed for partition. The final judgment directed the appointment of a Commissioner to oversee the partition process and account for the estate's management and income during the relevant periods.

Nature of Litigation

Dispute over the partition of the Khurshid Jah Paigah estate among heirs.

Remedy Sought

Appellants sought partition of the estate and recognition of their inheritance rights.

Filing Reason

Claims arose following the abolition of Jagirs and the cessation of restrictions on property division.

Previous Decisions

The High Court confirmed the Single Judge's ruling regarding the estate's management and claims.

Issues

Whether the properties of the Paigah estate can be partitioned among the heirs of Nawab Khurshid Jah following the abolition of Jagirs.

Submissions/Arguments

Appellants argued that the historical restrictions on partition ceased to apply after the abolition of Jagirs. Respondents contended that the Nizam's directives still governed the estate's management and inheritance.

Ratio Decidendi

The court recognized that the abolition of Jagirs altered the legal landscape, allowing heirs to seek partition of the estate, which had previously been restricted by the Nizam's directives.

Judgment Excerpts

Delay condoned. The dispute on hand relates to a Paigah granted to a person by name Khurshid Jah. The Nizam stated that whatever property had hitherto been acquired or articles purchased or buildings constructed out of the income of the Paigahs will be considered the property of the Paigahs and not that of any individual. The Jagirs in Hyderabad State including Paigah having been abolished by Jagir Abolition Regulation No. 69 of 1358 F, with effect from 15th August 1949 the Said Firmans precluding the partition of the aforesaid two categories of Mathruka properties, ceased to be operative.

Procedural History

The case originated from a civil suit filed in the City Civil Court, Hyderabad, which was later withdrawn and transferred to the High Court. The suit underwent several amendments and the parties entered into a compromise in 1961, leading to a judgment and decree passed by the High Court.
