Case Note & Summary

The dispute arose from a civil suit filed by the appellant's mother for declaration and perpetual injunction, where the appellant acted as her power of attorney. Following the death of the plaintiff on 10.01.2020, the appellant sought to substitute himself as the legal representative, asserting that a Will executed by his mother in his favor existed. The Trial Court dismissed this application, citing the presence of other legal heirs, which led the appellant to file a revision petition in the High Court. The High Court upheld the Trial Court's decision, stating that the appellant should have impleaded the other heirs. The Supreme Court, upon reviewing the matter, found that the appellant was indeed the son of the deceased and thus a legal heir. The Court held that the Trial Court should not have dismissed the substitution application outright and could have conducted an inquiry as per the provisions of the Code of Civil Procedure. Consequently, the Supreme Court set aside the previous orders and restored the application for reconsideration, allowing the appeal without costs.
