Case Note & Summary

The appellant challenged the order of the High Court of Kerala, which set aside the Kerala Administrative Tribunal's (KAT) decision to grant pensionary benefits by condoning a break in service. The appellant had worked in the Telecom Department from 05.02.1974 to 31.05.1984, followed by employment in a Public Sector Undertaking, Steel Industries Limited, Kerala (SILK), from 04.06.1984 to 31.05.1987, and then in the Technical Education Department until retirement on 30.06.2006. The contested issue arose when the appellant claimed pensionary benefits considering the earlier service in the Telecom Department, which was under the Central Government. The Accountant General informed that the break in service of nearly three years could not be condoned unless permitted by the State Government. The appellant's requests for condonation were rejected, leading to an appeal to the KAT, which ruled in favor of the appellant, allowing the pension benefits by condoning the break. The High Court, however, set aside this order, prompting the appellant to appeal to the Supreme Court. The Supreme Court noted that the appellant's service in SILK was not pensionable and that the break needed to be condoned to provide continuity of pensionable service. The court examined relevant Government Orders and concluded that the KAT's decision was justified, restoring the order for implementation. The appeal was allowed with no costs, and pending applications were disposed of.
