Case Note & Summary

The Supreme Court of India addressed the issue of limitation periods in light of the COVID-19 pandemic through Miscellaneous Application No. 665 of 2021. The Court initially took Suo Motu cognizance of the difficulties faced by litigants in filing various legal proceedings due to the pandemic, leading to an order on 23.03.2020 that extended limitation periods from 15.03.2020 until further notice. As the situation improved, the Court modified this order on 08.03.2021, excluding the period from 15.03.2020 to 14.03.2021 from limitation calculations and allowing a 90-day period from 15.03.2021 for cases where limitation would have expired during that time. However, a resurgence of COVID-19 cases prompted the Supreme Court Advocates on Record Association (SCAORA) to seek restoration of the earlier order. On 27.04.2021, the Court acknowledged the ongoing pandemic's impact and restored the original order, extending limitation periods until further notice. The Court clarified that the period from 14.03.2021 onwards would also be excluded from limitation calculations under specific laws. After hearing various parties, including the Attorney General and representatives from the Election Commission and SCAORA, the Court concluded that the initial order was no longer necessary but decided to restore the modified order dated 08.03.2021 with further extensions. The final directions included excluding the period from 15.03.2020 to 02.10.2021 in computing limitation periods and allowing a 90-day period from 03.10.2021 for cases where limitation would have expired during that timeframe. The Government of India was also directed to amend guidelines for containment zones to facilitate necessary legal and educational functions.
