Case Note & Summary

The case involved three appellants convicted under Section 302/149 and Section 323/149 of the Indian Penal Code (IPC) for their roles in a murder and assault that occurred on 01.11.1983. The appellants were sentenced to rigorous imprisonment for life, with concurrent sentences for lesser charges. The prosecution's case relied on eyewitness accounts, particularly from P.W. 7 and P.W. 8, who claimed to have witnessed the assault. The appellants challenged the charges, arguing that the framing of the charge under Section 147 IPC was defective and that they were denied a fair opportunity to defend themselves during the examination under Section 313 of the Code of Criminal Procedure, 1973 (Cr.P.C.). They contended that the prosecution evidence was inconsistent and that the absence of injury reports for some witnesses undermined their credibility. The State countered that the examination process was adequate and that the appellants failed to demonstrate any prejudice. The court analyzed the evidence, including the testimonies of the eyewitnesses and the procedural aspects of the trial. It concluded that the appellants were aware of the charges against them and that the alleged defects did not result in any prejudice. The court upheld the convictions, stating that the evidence of the eyewitnesses was credible and sufficient to support the charges. The appeals were dismissed, and the appellants were directed to surrender to serve their sentences.
