Case Note & Summary

The dispute arose from the acquisition of land belonging to the appellants under the Land Acquisition Act, 1894. A notification was issued on 23.05.2002, followed by a declaration on 17.12.2002, and an Award was passed on 01.10.2003, awarding compensation of Rs.1,97,08,397/ to the appellants. Subsequently, a Review Award was issued on 14.07.2004, reducing the compensation by Rs.49,39,195/ due to alleged illegal structures on the land, which the appellants contested as they were unaware of this Review Award until informed through an RTI application. The appellants filed two Writ Petitions challenging the Review Award and seeking compensation for a Supplementary Award dated 27.10.2004. The Delhi High Court dismissed both petitions, leading to the current appeals. The appellants argued that the original Award had become final and could not be reviewed, while the respondent contended that the Collector could correct mistakes at any time. The Supreme Court analyzed the provisions of the Land Acquisition Act, particularly Section 13A, which allows for correction of clerical errors but does not permit a review of the Award. The court emphasized that the Review Award was not a correction but a review, which is not allowed under the Act. The court concluded that the Review Award was invalid and quashed it, reinstating the original Award and the Supplementary Award, thus entitling the appellants to the full compensation. No costs were awarded.
