Case Note & Summary

The Supreme Court addressed appeals challenging a High Court order regarding eligibility for the Ex-servicemen category in recruitment for Rajasthan State and Subordinate Services. The case arose from an advertisement published on June 18, 2013, inviting applications for various posts, with a subsequent corrigendum increasing the number of posts. A Press Note issued on November 12, 2014, allowed candidates to correct their application forms, which led to disputes over eligibility. The writ petitioners, who were serving in the Army, sought to change their status to Ex-servicemen after the last date for application submission. The Single Bench dismissed their petitions, stating they were not Ex-servicemen by the last application date. However, the Division Bench overturned this, claiming the Press Note shifted the eligibility date. The Supreme Court found merit in the Commission's argument that the Press Note was only for correcting existing applications and did not allow for new eligibility claims. The Court emphasized that the amendment to the rules allowing those retiring within a year to apply did not have retrospective effect. Consequently, the Supreme Court set aside the High Court's order while allowing those already appointed under the High Court's decision to retain their positions, invoking Article 142 of the Constitution. The appeals were thus allowed.

Nature of Litigation

Appeals against the High Court's order regarding eligibility for Ex-servicemen category in recruitment.

Remedy Sought

The Rajasthan Public Service Commission sought to challenge the High Court's decision.

Filing Reason

The High Court's order was claimed to have shifted the eligibility date improperly.

Previous Decisions

The Single Bench dismissed the writ petitions, which was later overturned by the Division Bench.

Issues

Whether the Press Note shifted the eligibility date for Ex-servicemen category applicants. Whether the amendment to the rules had retrospective effect.

Submissions/Arguments

The Commission argued that the Press Note was only for corrections and did not allow new eligibility claims. The respondents contended that the Press Note intended to provide opportunities for retiring Army personnel.

Ratio Decidendi

The Press Note did not shift the eligibility date for Ex-servicemen; it was only meant for correcting existing applications. The amendment allowing those retiring within a year to apply did not have retrospective effect.

Judgment Excerpts

The view taken by the learned Single Judge in the impugned decision that the two had yet to acquire the status of Ex-servicemen by the last date for filling the applications pursuant to the advertisement dated June 18, 2013, has overlooked the fact that on November 12, 2014 another advertisement was issued which would have the effect of shifting the date of eligibility norms acquiring to November 28, 2014. We find that the High Court has erred in law in shifting the eligible date on the basis of Press Note which was restricted only for correction of mistakes or change of category.

Procedural History

The appeals were filed against the Division Bench's order dated May 26, 2017, which set aside the Single Bench's dismissal of the writ petitions.
