The petitioner, a retired librarian of a private aided school, sought pension benefits under the Old Pension Scheme. The respondents, including the Education Officer and the Accountant General, denied him the Old Pension Scheme and limited his pension to the period of full-time service, prompting the filing of a writ petition before the Bombay High Court. The Court, after examining the matter, found the issue no longer res integra and relied on a series of precedents, notably Sunanda Sahatragun Ingale vs. State of Maharashtra and others, which held that 50% of part-time service should be reckoned for qualifying service and that the Old Pension Scheme applied to such employees. The Court rejected the distinction between part-time and full-time service for pensionary benefits. Accordingly, the writ petition was allowed; the impugned order dated 01.12.2020 denying the petitioner the Old Pension Scheme was quashed; and the respondents were directed to confer pensionary benefits under the Old Pension Scheme counting 50% of the part-time service tenure, with arrears to be released within eight weeks.
