The respondent contended that identical pay scales and Rule 35(b) required seniority from 1994 and relied on a Division Bench judgment. The court examined the nature of the two services and their promotion avenues, holding that Steno-typist Grade-III and Assistant belong to different services with distinct career paths. The transfer was by option, and the date of appointment as Assistant was the relevant date for seniority in the Ministerial line. Rule 35(aa) specifically applies where recruitment is by more than one method and mandates seniority from the date of appointment to that service. Rule 35(b) did not assist because it related to transfer within the same class or category, not to a different service. The earlier Division Bench judgment was distinguishable as it did not involve a transfer to a different service. Consequently, the department’s fixation of seniority from 2008 was correct, and the writ order was set aside. The appeal was allowed with no costs.
