Case Note & Summary
The matters arose from execution proceedings concerning two decrees obtained by related decree holders against a judgment debtor, a sole proprietor. The appellant objectors, father and daughter, are not parties to the underlying suits. They filed objections under Order XXI Rule 58 of the Code of Civil Procedure, 1908, challenging the attachment of an immovable property, an apartment, in execution of the decrees. The apartment was registered in appellant No.1's name via a 2012 sale deed and was gifted to appellant No.2 by a registered gift deed dated 26.06.2023, prior to the attachment. The decree holder in one execution claimed the judgment debtor had a 1/3rd share in the property based on an unsubstantiated assertion of joint purchase and a release deed executed by another son. The Commercial Court partially allowed the objection in that execution, lifting attachment to the extent of 2/3rd share but maintained attachment on 1/3rd share, holding the judgment debtor had a pre-existing right. In the other execution, the court dismissed the objection as not maintainable because no attachment had been effected, but directed that proceeds from the 1/3rd share attached in the related execution could satisfy that decree too. The objectors appealed under Section 13(1A) of the Commercial Courts Act, 2015, arguing the judgment debtor had no share and the property was transferred before attachment. At the time of this incomplete judgment, the court was analyzing the evidence led by the objectors, focusing on whether the judgment debtor had any share in the property in light of the release deed and other documents.
Headnote
A) Civil Procedure - Execution - Attachment and Objection - Order XXI Rule 58 Code of Civil Procedure, 1908 - Maintainability when no attachment effected - In Com.Ex.No.240/2023, no warrant of attachment was executed; thus, objection application under Order XXI Rule 58 was held not maintainable. Application dismissed on that ground, but court directed that proceeds from attached 1/3rd share in related execution may satisfy this decree (Paras 5-6, 12).
B) Civil Procedure - Execution - Attachment and Objection - Order XXI Rule 58 Code of Civil Procedure, 1908 - Determination of judgment debtor's share - Court examined whether evidence establishes joint ownership. Decree holder asserted joint purchase and release deed showing judgment debtor's share. Objectors claimed property was self-acquired by appellant No.1 and later gifted to appellant No.2 prior to attachment. Court considered release deed Ex.D1 as indicative of a pre-existing right, but full analysis of evidence remains incomplete (Paras 13-21).
Issue of Consideration
Whether the judgment debtor has any share in the subject property that was attached in execution proceedings; whether an application under Order XXI Rule 58 CPC is maintainable if no attachment has been effected
Law Points
- Under Order XXI Rule 58 CPC
- objectors not party to decree can resist attachment
- burden on decree holder to prove judgment debtor's share
- release deed considered evidence of pre-existing right
- attachment must be executed for objection to lie

Nature of Litigation
Execution proceedings wherein objectors not party to the decree resist attachment of immovable property under Order XXI Rule 58 CPC
Remedy Sought
Appellants seek to set aside the orders dated 29.08.2025 in Com.Ex.No.241/2023 and Com.Ex.No.240/2023, and to allow their applications under Order XXI Rule 58 CPC
Filing Reason
Appellants claim the judgment debtor has no share in the attached property, and that the property was transferred by gift deed to appellant No.2 prior to the attachment
Previous Decisions
Commercial Court passed orders on 29.08.2025 in Com.Ex.No.241/2023 holding judgment debtor has 1/3rd share and maintaining attachment to that extent; in Com.Ex.No.240/2023, application dismissed as property was not attached, but court directed that sale proceeds from the 1/3rd share may satisfy that decree
Issues
Whether the judgment debtor has any share in the subject property?
Whether an application under Order XXI Rule 58 CPC is maintainable when no attachment has been effected?
Submissions/Arguments
Appellants: The judgment debtor has no share in the subject property; the property was self-acquired by appellant No.1 and was gifted to appellant No.2 before any attachment.
Decree holder: The subject property was jointly purchased, and a release deed shows the judgment debtor's pre-existing right to a share.
Judgment Excerpts
the learned Commercial Court tried the said application as a suit and concluded that the subject property is a joint property of the appellants and the JDR.
the learned Commercial Court rejected the said application on the ground that it was not maintainable, as the subject property was not attached.
the first and foremost question to be addressed is whether the JDR has or had any share in the subject property.
the only document on which the impugned orders are premised is Ex.D1, which is a release deed executed by appellant No.1's son - Sri.Sridhar V.S. in favour of the appellants and JDR.
