Case Note & Summary

The petitioner, D. Santhi, a teacher, had earlier filed W.P.(MD)No.11753 of 2021 before the Madurai Bench of the Madras High Court challenging an order dated 28.12.2020 that denied her annual increments, incentive, surrender leave benefits, pay fixation, and allowances from the date of her appointment on 03.10.2017. The writ court, by judgment dated 23.09.2021, allowed the petition, quashed the impugned order, and directed the respondent authorities, namely the District Educational Officer and the Block Educational Officer, to award all the aforesaid benefits without insisting on passing the Teacher Eligibility Test, subject to any modification by the court. Alleging that the respondents failed to comply with this directive, the petitioner instituted the present contempt petition under Sections 11 and 12 of the Contempt of Courts Act, seeking initiation of contempt proceedings for wilful disobedience. When the matter came up for hearing, the learned Special Government Pleader appearing for the respondents submitted that the order had been fully complied with. An order dated 11.03.2025 passed by the first respondent was placed on record, and a copy was furnished to the petitioner’s counsel. It was stated that the petitioner had been granted annual increments, incentive, surrender leave benefits, pay fixation, and allowances from the date of her appointment. The court recorded the submission and the compliance order, and consequently closed the contempt petition. No further directions were issued. The primary legal issue was whether the respondents had wilfully disobeyed the earlier order, constituting contempt. However, given the demonstrated compliance, the court accepted that the direction stood satisfied. The ratio of the decision is that once an order is complied with, contempt proceedings lose their purpose and are closed, as wilful disobedience is a necessary ingredient for contempt. The petition was therefore closed, and no punishment was awarded.

Nature of Litigation

Contempt petition alleging wilful disobedience of a writ court order directing grant of service benefits to a teacher.

Remedy Sought

Petitioner sought punishment of the respondents for contempt and compliance of the order dated 23.09.2021.

Filing Reason

Non-compliance of the order dated 23.09.2021 in W.P.(MD)No.11753 of 2021 which directed the respondents to award annual increments, incentive, surrender leave benefits, pay fixation and allowances without insisting on passing the Teacher Eligibility Test.

Previous Decisions

The writ petition W.P.(MD)No.11753 of 2021 was allowed on 23.09.2021, quashing the impugned order dated 28.12.2020 and directing the respondents to grant the said benefits. The respondents initially did not comply, leading to the filing of this contempt petition.

Issues

Whether the respondents committed wilful disobedience of the court order dated 23.09.2021 and thereby committed contempt.

Submissions/Arguments

Petitioner argued that despite the order, benefits were not granted, constituting wilful disobedience and contempt. Respondents submitted that a compliance order dated 11.03.2025 had been passed and the benefits were granted, thus the order was fully complied with.

Ratio Decidendi

Once the order of the court is complied with, the contempt proceedings are closed; compliance negates the allegation of wilful disobedience.

Judgment Excerpts

Today, when the matter is being taken up, Mr.F.Deepak, learned Special Government Pleader submits that the order passed by this Court, dated 23.09.2021 has been fully complied with and in this regard, an order, dated 11.03.2025 has been passed by the first respondent. The copy of the order has been produced before this Court, which is taken on record. The copy of the order, dated 11.03.2025 was also given to Mr.T.Pon Ramkumar, learned Counsel for the petitioner. Procedural History
