Case Note & Summary
The dispute arose out of the seniority fixation of Junior Assistants appointed on compassionate grounds in the Agriculture Department of Tamil Nadu. The petitioners were appointed in 2000 and completed their probation; their seniority was fixed in the year 2000 itself. In 2007, the second respondent Director of Agriculture issued an order placing all compassionate appointees of that year below the direct recruits selected through the Tamil Nadu Public Service Commission. The petitioners, who had been promoted as Assistants in 2008, challenged this order only in 2019 by filing a writ petition under Article 226 of the Constitution, seeking to quash the orders dated 27.06.2007 and 28.06.2018 and to direct the respondents to fix seniority in accordance with Section 40(1) and (2) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016. They contended that as per Section 40(1), seniority should be reckoned from the date of commencement of probation, which was earlier for them than for the direct recruits, and therefore they should rank above. The respondents defended the fixation stating that Section 40(2) applied as recruitment was by more than one method, and seniority was to be determined by the date of appointment to the service; the impugned orders were based on the earlier Rule 35(aa) now sub-section (2) of Section 40. The court examined the statutory provision and found no infirmity in the fixation. Additionally, the court noted that the petitioners were aware of the seniority list since 2007 and had not raised any objection for over a decade; relying on the Supreme Court decision in Vijay Kumar Kaul v. Union of India, (2012) 7 SCC 610, it held that unexplained delay and laches disentitle them to any relief under Article 226. The writ petition was dismissed with no costs, and the connected miscellaneous petitions were closed.
Headnote
A) Service Law - Seniority - Section 40(2) of Tamil Nadu Government Servants (Conditions of Service) Act, 2016 - Seniority in service where recruitment is by more than one method - The second respondent fixed seniority of compassionate appointees below direct recruits by applying Rule 35(aa) now sub-section (2) of Section 40, which provides that seniority shall be determined with reference to the date of appointment to that service. The court found no violation of statutory provisions in this fixation. (Paras 5-7)
B) Writ Jurisdiction - Delay and Laches - Article 226 of the Constitution of India - A writ petition challenging an order passed 12 years earlier, with petitioners aware of it since 2007, is dismissed on the ground of delay. The court relied on Supreme Court decision in Vijay Kumar Kaul v. Union of India, (2012) 7 SCC 610, holding that unexplained delay causes equity to extinguish. (Paras 9-10)
Issue of Consideration
Whether the seniority fixation of compassionate appointees below direct recruits violated Section 40(1) and (2) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, and whether the writ petition was maintainable after a delay of 12 years.
Final Decision
The writ petition was dismissed on grounds of delay and laches, and on merits, the seniority fixation was in accordance with Section 40(2) of the Act. No costs. Consequently, connected W.M.P.(MD) Nos.717 and 718 of 2019 were closed.

Nature of Litigation
This writ petition under Article 226 of the Constitution sought to quash the orders dated 27.06.2007 and 28.06.2018 of the second respondent, which fixed the seniority of compassionate appointees below direct recruits, and to enforce Section 40(1) and (2) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 for seniority fixation.
Remedy Sought
Petitioners sought a writ of certiorarified mandamus to quash the impugned orders and direct the respondents to fix seniority among compassionate appointees and direct recruits for promotion.
Filing Reason
Petitioners, appointed as Junior Assistants on compassionate grounds in 2000, were placed below direct recruits in the seniority list, allegedly contrary to Section 40(1) and (2) of the Act, affecting their promotion chances.
Previous Decisions
The second respondent had passed the impugned order in 2007 fixing seniority, which the petitioners challenged only in 2019 after they were promoted as Assistants in 2008.
Issues
Whether the impugned seniority fixation orders violated Section 40(1) and (2) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016
Whether the writ petition was maintainable after a delay of over 12 years in challenging the 2007 order
Submissions/Arguments
Petitioners argued that the impugned order violated Section 40(1) and (2) of the Act; seniority should be from date of joining duty/probation; compassionate appointees who joined earlier should be above direct recruits.
Respondents contended that the orders followed Rule 35(a) and (aa) and Section 40(2); seniority determined by date of appointment; petitioners were aware since 2007 and raised no objection then; delay and laches.
Ratio Decidendi
Under Section 40(2) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, where recruitment is by multiple methods, seniority shall be determined with reference to the date of appointment to that service. Additionally, a writ petition challenging a seniority list after an inordinate delay of over a decade, without any explanation for the delay, is liable to be dismissed on the ground of delay and laches.
Judgment Excerpts
The above Section provides that where the normal method of recruitment to the service is by more than one method of recruitment, seniority of a person shall be determined with reference to the date on which he or she is appointed to that service.
It becomes an obligation to take into consideration the balance of justice or injustice in entertaining the petition or declining it on the ground of delay and laches. It is a matter of great significance that at one point of time equity that existed in favour of one melts into total insignificance and paves the path of extinction with the passage of time.
Procedural History
The petitioners were appointed as Junior Assistants on compassionate grounds in 2000. The second respondent fixed their seniority by order dated 27.06.2007. The petitioners were promoted as Assistants in 2008. In 2018, a consequential order was passed. The petitioners submitted a representation seeking revision of seniority and subsequently filed the present writ petition in 2019, challenging both orders.
