The appellant, an Associate Professor of Malayalam at S.T. Hindu College, Nagercoil, joined service on 04.02.1991. In the academic years 2019-2020 and 2020-2021, only one student opted for Malayalam as first language, and from 2021-2022 onwards, no student enrolled. The Director of Collegiate Education, citing a policy requiring at least ten students to sustain a language department, issued a deployment order dated 16.08.2024 transferring the appellant to Sri Devi Kumari Women’s College, Kuzhithurai, about 30 kilometres away. The appellant challenged the order alleging malice and contending that his responsibilities as officer-in-charge of the NCC unit would be adversely affected. The respondents maintained that the deployment was purely administrative due to declining student strength and that the NCC Commandant had post-ratified the move on 10.01.2025. The Single Judge dismissed the appellant’s writ petition on 02.01.2025, holding that the deployment was on account of fall in student numbers, the appellant could be repatriated upon revival of student strength, and no prejudice would be caused. In the intra-court writ appeal, the Division Bench reviewed the material and found no mala fides; the deployment was based on facts and made in the interest of students. The Court upheld the Single Judge’s order but directed the management and the Collegiate Education Department to ensure that the appellant’s monetary benefits were protected and that he joined the new college without hurdle. The appeal was dismissed with no order as to costs, and the connected miscellaneous petition was closed.
