Case Note & Summary
The matter pertained to two applications filed by the Official Trustee of Tamil Nadu (AG & OT) against the respondent, M/s.M.Chelapathi Rao, concerning property at No.21, Harrington Road, Chetpet, Chennai. The respondent was a tenant under a lease agreement that had expired and was not renewed. The Official Trustee sought a direction for the respondent to quit and deliver vacant possession of the property, and alternatively, to authorize taking over possession through police force if the respondent failed to comply. It was undisputed that the Official Trustee had already taken possession of the property, but the respondent's movable goods remained inside, and the premises had been double-locked by the Official Trustee. The respondent contended that physical possession was still with him and that the double-locking by the Official Trustee had created a complex situation. The Official Trustee argued that the market rental value of the property was Rs.7,95,000 per month, and any renewal would require payment of that amount. The respondent submitted that the rent suggested was exorbitant and not feasible. The Court, upon considering the facts, noted that the lease period had expired without renewal, leaving no option but to order eviction. However, in view of the double-locking and the presence of the respondent's goods, the Court crafted a procedure for orderly removal. It directed the respondent to vacate and deliver vacant possession of the property by removing all movable belongings. The Official Trustee was directed to fix a date and time for removal within four weeks, during which the respondent was to cooperate. In the event of non-cooperation, the Court authorized the Official Trustee to initiate action for removal of the goods in the presence of Revenue Officials, and if necessary, with police assistance. Application No.2501 of 2025 was allowed, and Application No.2503 of 2025 was disposed of with the above directions.
