Case Note & Summary

The appeal was filed by the claimants-appellants, being the legal representatives of the deceased K.K. Shivalingaiah, who died in a motor vehicle accident. The claimants sought enhancement of compensation awarded by the Tribunal in MVC No.1508/2007. The Tribunal had awarded a total compensation of Rs.5,27,280/- with interest at 6% per annum. The High Court, after hearing the parties, found that the Tribunal had erred in adopting a multiplier of 13 based on the age of the deceased (35 years) instead of the correct multiplier of 16 as per the settled law in Sarla Verma v. DTC. The High Court recalculated the loss of dependency by taking the monthly income of the deceased at Rs.4,500/-, deducting 1/3rd towards personal expenses, and applying multiplier 16, resulting in a loss of dependency of Rs.5,76,000/-. Adding conventional heads of Rs.5,000/- for loss of consortium, Rs.5,000/- for loss of estate, and Rs.2,000/- for funeral expenses, the total compensation was enhanced to Rs.5,88,000/-. The High Court also enhanced the rate of interest from 6% to 8% per annum from the date of petition till deposit. The appeal was allowed in part.

Nature of Litigation

Appeal against judgment and award of Motor Accident Claims Tribunal seeking enhancement of compensation.

Remedy Sought

Enhancement of compensation awarded by the Tribunal.

Filing Reason

The claimants were dissatisfied with the quantum of compensation awarded by the Tribunal.

Previous Decisions

The Tribunal in MVC No.1508/2007 awarded Rs.5,27,280/- with interest at 6% per annum.

Issues

Whether the compensation awarded by the Tribunal is just and proper? Whether the multiplier adopted by the Tribunal is correct?

Submissions/Arguments

The claimants argued that the Tribunal erred in adopting multiplier 13 instead of 16 as per Sarla Verma v. DTC. The claimants sought enhancement of compensation and higher interest rate.

Ratio Decidendi

The correct multiplier for a deceased aged 35 years is 16 as per Sarla Verma v. DTC, and the Tribunal's adoption of multiplier 13 was erroneous. The loss of dependency must be recalculated accordingly.

Judgment Excerpts

The Tribunal has committed an error in adopting multiplier 13 instead of 16 as per the decision of the Apex Court in Sarla Verma v. DTC. The compensation is enhanced to Rs.5,88,000/- with interest at 8% per annum.

Procedural History

The claimants filed MVC No.1508/2007 before the Civil Judge (Sr.Dn) and Additional Motor Accident Claims Tribunal, Kunigal, which awarded compensation on 23/12/2009. Aggrieved, the claimants filed MFA No.3069/2010 before the High Court of Karnataka.
