The appellant, Sannabasavaraja @ Basavaraja, was employed as a cleaner of a bus bearing registration No.KA-16/A-3034 owned by the first respondent, Smt. B.S. Pushpalatha. On 17.04.2010, he sustained injuries in a motor vehicle accident arising out of and in the course of his employment, resulting in permanent partial disablement. He filed a claim petition before the Labour Officer and Commissioner for Workmen's Compensation, Davanagere, which was registered as KA AA DA NA PA/CR-132/2010. The Commissioner, by judgment dated 29.08.2011, awarded compensation of Rs.1,21,997/- with interest at 12% per annum from the expiry of 30 days from the date of the judgment. Aggrieved by the inadequacy of the compensation, the appellant filed this appeal under Section 30(1) of the Workmen's Compensation Act, 1923 (hereinafter referred to as 'the Act') seeking enhancement. The High Court heard the learned counsel for the appellant, Sri R. Shashidhara, and the learned counsel for the second respondent-insurance company, Sri P.S. Jagadish. The notice to the first respondent was dispensed with. The court noted that the Commissioner had assessed the loss of earning capacity at 15% based on the medical evidence. However, considering the nature of the injuries and the appellant's occupation as a cleaner, which requires physical agility, the court found that the loss of earning capacity should be assessed at 30%. Accordingly, the court recalculated the compensation. The court also modified the interest component, directing that interest at 12% per annum be paid from the date of the accident, i.e., 17.04.2010, instead of from the expiry of 30 days from the judgment. The appeal was allowed in part, and the compensation was enhanced to Rs.2,43,994/- with interest as directed.

The appellant is entitled to interest at 12% per annum on the enhanced compensation from the date of the accident, i.e., 17.04.2010, till the date of deposit. The respondent-insurance company is directed to deposit the enhanced compensation with interest within four weeks from the date of receipt of a copy of this judgment.
