The claimant, the owner of the jeep, filed a petition before the Motor Accidents Claims Tribunal (MACT) at Hassan seeking compensation for the repair costs. The KSRTC contended that it was not liable as the bus was taken on hire from its original owner, M/s Road Links Pvt. Ltd., and that the owner alone was responsible. The respondents included the Superintendent of Police, Hassan, the bus driver Althaf Hussain, the insurer Oriental Insurance Co. Ltd., and the owner M/s Road Links Pvt. Ltd. The court considered the issue of joint liability of the hirer and owner. The court held that the KSRTC, as the hirer of the bus, was jointly and severally liable with the owner for the negligence of the bus driver, and the insurer was liable to indemnify the owner.
