Case Note & Summary

The case involves two appeals arising from a motor accident claim. The claimant, Smt. Reshma S. Ganga, was a passenger in a KSRTC bus on 23.02.2009 when the bus driver applied sudden brakes to avoid collision with a lorry, causing her to fall and sustain injuries including fracture of left clavicle and other injuries. She was treated at various hospitals. The Motor Accident Claims Tribunal partly allowed her claim petition, awarding compensation of Rs. 1,50,000/- with interest. Dissatisfied, the claimant filed MFA No. 11109/2011 seeking enhancement. The KSRTC Corporation filed MFA No. 10583/2011 challenging the finding of negligence and the quantum. The High Court considered the evidence and arguments. The court held that the bus driver was negligent as he failed to control the speed and applied sudden brakes, and the claimant, being a passenger, could not be attributed contributory negligence. On quantum, the court enhanced compensation to Rs. 2,50,000/- under various heads including pain and suffering, loss of amenities, medical expenses, and future medical expenses. The Corporation's appeal was dismissed, and the claimant's appeal was allowed in part.

Nature of Litigation

Appeals against judgment and award of Motor Accident Claims Tribunal in a claim petition for compensation for injuries sustained in a motor vehicle accident.

Remedy Sought

Claimant sought enhancement of compensation; Corporation sought reduction of compensation and challenge to finding of negligence.

Filing Reason

Claimant was injured as a passenger in a KSRTC bus due to sudden brake applied by driver to avoid collision with a lorry.

Previous Decisions

The Motor Accident Claims Tribunal partly allowed the claim petition awarding Rs. 1,50,000/- with interest.

Issues

Whether the finding of negligence against the KSRTC bus driver is correct? Whether the claimant is entitled to enhanced compensation?

Submissions/Arguments

Claimant argued that the Tribunal erred in awarding low compensation and that the driver was negligent. Corporation argued that the accident occurred due to sudden brake to avoid collision and that the claimant contributed to the accident by not holding the handrail.

Ratio Decidendi

The bus driver was negligent in driving as he failed to control the speed and applied sudden brakes, causing injury to a passenger. A passenger cannot be held contributorily negligent. Compensation must be just and reasonable, considering the nature of injuries, medical expenses, pain and suffering, loss of amenities, and future medical expenses.

Judgment Excerpts

The driver of the bus ought to have been more careful while driving the bus and he ought to have controlled the speed of the bus. The claimant being a passenger in the bus cannot be attributed with contributory negligence. The compensation awarded by the Tribunal is on the lower side and requires to be enhanced.

Procedural History

The claimant filed MVC No. 204/2009 before the II Additional Senior Civil Judge and Additional Motor Accident Claims Tribunal-7, Shimoga, which partly allowed the claim on 06/08/2011. Both the claimant and the Corporation filed appeals before the High Court of Karnataka.
