The appellant, Muniswamy, filed a claim petition under the Motor Vehicles Act, 1988, seeking compensation for injuries sustained in a road accident on 28.12.2006. He was standing by the roadside near Auto Mart Junction, Sarjapura Road, when a Honda Activa scooter (KA-01-ED-7301) driven rashly and at high speed dashed against him, causing grievous injuries. He was treated at St. John's Medical College Hospital. The Tribunal partly allowed the claim and awarded Rs. 1,10,000/-. Dissatisfied, the appellant filed this appeal seeking enhancement. The High Court, after considering the evidence, including medical bills and disability certificate, found that the Tribunal had not adequately compensated for medical expenses, loss of income during treatment, pain and suffering, and future disability. The Court enhanced the compensation to Rs. 2,00,000/- with interest at 6% per annum from the date of petition till deposit. The appeal was allowed in part.
