The petitioner, Veerayya F. Kotyalmath, was appointed as an English teacher in Shri Jagadguru Annadaneshwari High School, Mundargi, on 2 November 1988, with approval from 19 November 1988. Respondent No.5, Smt. R.R. Inamdar, was appointed as an English teacher on 1 December 1990. The petitioner claimed that he was senior to Respondent No.5 and that his seniority was overlooked when Respondent No.5 was promoted to English Lecturer. He contended that the post of English Lecturer was a single post and therefore reservation could not apply, and that his seniority should have been considered. The petitioner unsuccessfully challenged the promotion before the statutory appellate authority, which dismissed his appeal. He then filed a writ petition under Articles 226 and 227 of the Constitution of India. The State argued that the petitioner proceeded on the wrong premise that there is subject-wise reservation of posts of teachers and lecturers, and that the vacant post of English lecturer could be filled by direct recruitment or promotion in the concerned Composite Junior College as per the reservation policy and roster system.
