Case Note & Summary
The petitioner, Smt. Jyothi G, was charge sheeted for an offence under Section 3 read with 13 of the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993. The allegation was that on instructions of the accused persons (PDO, Bill Collector, and watermen), workers cleaned manholes with bare hands and cleared accumulated garbage. The complainant, the Tahsildar, lodged a complaint directly with the jurisdictional police on 12.11.2012, which led to FIR No.296/2012 and CC No.324/2013 before the JMFC, T Narasipura. The petitioner filed a petition under Section 482 CrPC to quash the proceedings. The petitioner's counsel argued that the complaint was lodged in violation of Section 17(3) of the Act, which prescribes the procedure for filing complaints, and that cognizance was taken beyond the limitation period under Section 18 of the Act. The court examined the records and found that the Tahsildar directly approached the police, bypassing the procedure under Section 17(3). Additionally, the cognizance was taken after the expiry of the limitation period specified in Section 18. Consequently, the court held that the entire proceedings were vitiated and quashed the proceedings in CC No.324/2013.
