The petitioner, Sri Pankaj L Kothari, was the sole defendant in a small causes case (S.C.1845/12) filed by the respondent, Sri T.K. Nagaraj, seeking eviction from suit schedule premises bearing No.1846/B, 4th Cross, 'D' Block, Rajajinagar II Stage, measuring 1,700 sq. feet. The petitioner challenged the jurisdiction of the XVI Small Causes Judge, Bengaluru City, to entertain the eviction petition on the ground that he denied the existence of a landlord-tenant relationship. The petitioner filed an application under Section 151 CPC read with Section 8(1) of the Karnataka Small Causes Courts Act, 1964, which was dismissed by the Small Causes Court. Aggrieved, the petitioner filed this writ petition under Article 227 of the Constitution of India. The High Court held that when the defendant denies the jural relationship of landlord and tenant, the Small Causes Court has no jurisdiction to proceed with the eviction petition. The court set aside the order of dismissal and directed the Small Causes Court to return the plaint to the plaintiff for presentation before the proper court having jurisdiction.
