The petitioner, Smt. Yasmeen, was elected as a member of Gram Panchayat, Gonikoppa, in the election held on 20.4.2016. Subsequently, a notice was issued for the election of Adhyaksha and Upadhyaksha (President and Vice President) of the Panchayat. The petitioner submitted her nomination for the post of Vice President. However, the Competent Officer (Assistant Director, Social Welfare Department) rejected her nomination on 31.5.2016 on the ground that she did not produce a caste certificate. The petitioner challenged this rejection by filing a writ petition under Article 226 of the Constitution of India before the High Court of Karnataka. The court observed that the rejection was arbitrary and without any legal basis. The court noted that the petitioner had already been elected as a member of the Panchayat and there was no requirement for a caste certificate for contesting the election for the post of Vice President. The court quashed the proceedings of the respondent dated 31.5.2016 and directed the respondent to accept the petitioner's nomination and allow her to participate in the election process.
